Legal firms are increasingly falling under the same data protection mandates as the corporate customers they serve because of the sensitive nature of their client’s data. Many in the legal profession have come to rely on email to exchange documents, contracts and even intellectual property with their clients. However, this information cannot be guaranteed to be secured, protected or controlled with traditional email. Trying to implement separate ethical wall solutions, enterprise rights management infrastructures, meta data cleaning or encryption products internally and across the many different companies a legal firm communicates with is costly and unrealistic.

While trying to achieve compliance with HIPPA and other patient confidentiality information standards, and avoiding the potential penalties associated with non-compliance, many health care organizations have not been able to exchange Protected Health Information (PHI) to recipients outside the organization because of the costs and expense associated with MFT or email encryption solutions. As a result, many hospitals, doctor’s offices and health care facilities, in broadly interpreting the privacy act, simply refuse to release patient information or condition information. In some cases, this refusal even extends to the families of the hospitalized, even if the patient is critically ill and the family member lives out of the area.
